v5.45 Privacy changes explained.

There are a number of threads popping up about the removal of the 'privacy' opt-out with v5.45.

I'll have a go at explaining it, seeing that Piriform have made such a poor job of it (again).

Remember that this option was only ever added to comply with GDPR in Europe, it was never a legal requirement in the rest of the world.

They have previously been collecting this data anyway, they just weren't telling you about it until GDPR.

Piriforms' latest privacy statement says that their software is not collecting Personal Data from users.

If this is true then they do not have to offer the opt out under GDPR in Europe. (And never had to in the rest of the world).

It is correct under Data Protection Law that if the collected data cannot identify you personally then it is not an individual data protection concern and so is not covered by data protection law.
(Although it may be covered by other laws on anonymous data collection).
Of course that all depends on just what is being collected and if it could identify you, or your personal device, in any way.

Piriform say that the only personal data held is in connection with payments made for the 'Professional' versions.
This is subject to GDPR in Europe and you can make a request to see just what they hold about you by means of a Subject Access Request. See the statement linked above.
In the rest of the world you should have your own Data Protectction laws to cover this.

An Explanation of GDPR for those outside Europe.

The General Data Protection Regulations are an EEA wide set of regulations about personal data protection.

They are incorporated into each member countrys' own Data Protection Legislation.
Each countrys' own legislation then makes additions for certain areas like security and health records.

They are aimed at making what data/information organisations are storing about you, and what they are doing with it, more transparent and accessible.

They have put greater responsibilities on organisations that collect and/or process data; including:

  • Getting your explicit permission before collecting personal data.
  • Looking after your personal data securely.
  • Not holding personal data about you that is not needed by them.
  • Giving you timely and free access to what they do hold about you when requested.
  • Giving you some rights to have incorrect data corrected or removed altogether.
  • Notifying the relevant authority quickly if they suspect a data breach.

GDPR was mainly brough in to curb international organisations (especially online organisations such as Facebook, Google, Microsoft, etc.) inappropriate collection and use of an individuals personal data.
There had also been issues with organisations not reporting large breaches of personal user data for months or even years.

It does not matter where in the world the organisation operates, if they are holding or processing the personal data of EEA subjects then the organisation is subject to GDPR for that data.

Personal data can include anything that can identify you as an individual, name, address, account/ID numbers, etc.
It can also include information such as your vehicle registration, or with computer devices your MAC/IMEI/serial numbers etc.

Although GDPR is only law in Europe changes made to an organsations data protection policy to comply with GDPR are tending to get carried over to the rest of the world.
